Terms & Conditions

By engaging Evertrail Travel LLC, you (“Client”) agree to the following:

Agency Role

Evertrail Travel LLC acts solely as an independent contractor and agent for third-party travel suppliers (including but not limited to airlines, hotels, cruise lines, and tour operators). We do not own, operate, or control these suppliers.

Pricing & Availability

All prices are subject to change until confirmed and paid. Availability is not guaranteed until booking is completed.

Planning Fees

Planning and research fees agreed upon are non-refundable and compensate Evertrail Travel LLC for professional services rendered.

Payments & Authorizations

Client authorizes Evertrail Travel to process payments to suppliers on their behalf. Payment constitutes acceptance of the supplier’s terms and conditions.

Cancellations & Refunds

Cancellation policies vary by supplier. Refunds, if any, are subject to supplier rules. Evertrail Travel LLC is not responsible for supplier-imposed penalties.

Travel Protection

Travel protection is strongly recommended. By declining coverage, Client acknowledges and assumes all financial risks associated with cancellations, delays, medical emergencies, and travel interruptions.

Limitation of Liability

To the fullest extent permitted by New York law, Evertrail Travel LLC shall not be liable for:

  • Personal injury, property damage, or loss

  • Delays, cancellations, or schedule changes

  • Acts of God, weather, pandemics, government actions, or force majeure events

Travel Documentation

Client is responsible for obtaining and verifying:

  • Valid passports (minimum 6 months validity)

  • Visas and entry requirements

  • Vaccinations or health documentation

Chargebacks & Disputes

Client agrees not to initiate chargebacks for services properly rendered. Any disputes must be submitted in writing within 30 days of trip completion.

Governing Law

This agreement shall be governed by the laws of the State of New York. Any disputes shall be resolved in courts located in New York.

Seller of Travel Disclosure

Evertrail Travel LLC operates as an independent travel advisor and complies with applicable U.S. regulations. Registration in certain states may not be required.

Acknowledgment

By engaging with Evertrail Travel LLC, Client acknowledges that they have read, understood, and agreed to these terms.
